However, the mechanism connecting cardiac glycoside action to apoptosis is not known. It has been reported that compounds resembling digitoxin are able to reduce c-MYC expression. Furthermore, it has been previously shown that the transcription of c-MYC depends on nuclear factor of activated T -cells (NFAT) binding sites in the c-MYC promoter. We have therefore hypothesized that NFAT might mediate digitoxin effects on c-MYC mRNA message. Materials and Methods: We have chosen to study this process in HeLa cells where structurally intact c-MYC genes in 8q24 co-localize with human papilloma virus 18 at all integration sites. Results: Here we show that within the 1st h following treatment with digitoxin, a signiicant reduction in c-MYC mRNA occurs. This is followed by a precipitous loss of c-MYC protein, activation of caspase 3, and subsequent apoptotic cell death. To test the NFAT -dependence mechanism, we analyzed the effects of digitoxin on NFAT isoform-dependent auto-activation of a NFAT -luciferase expression system. Drug dependent effects on expression varied according to each of the four canonical NFAT isoforms (1, 2, 3 or 4). The most digitoxin-sensitive NFAT isoform was NFAT1. Using c-MYC chromatin immune precipitation, we ind that digitoxin inhibits interaction of NFAT1 with the proximal c-MYC promoter. Conclusions: These results suggest that the carcinotoxic activity of digitoxin includes suppression of NFAT -driven c-MYC expression. It finds that organizational structures (e.g., grievance and evaluation procedures, antiharassment policies) become symbolic indicators of rational governance and compliance with antidiscrimination laws, first within organizations, but eventually in the judicial realm as well. Lawyers and judges tend to infer nondiscrimination from the mere presence of those structures. Judges increasingly defer to organizational structures in their opinions, ultimately inferring nondiscrimination from their presence. Legal endogeneity theory is tested by analyzing a random sample of 1,024 federal employment discrimination opinions (1965–99) and is found to have increased over time. Judicial deference is most likely when plaintiffs lack clout and when the legal theories require judges to rule on unobservable organizational attributes. The authors argue that legal endogeneity weakens the impact of law when organizational structures are viewed as indicators of legal compliance even in the face of discriminatory actions. Sections 4 and 5 discuss, the Supreme Court's 2007 decision affirming the Department of Education's funding formula, how this case reflects the ongoing tension between various Justices concerning the appropriate level of deference that courts should accord to federal agency regulations, the role of expertise (here statistical science) in the public policy arena that includes judicial review of disputes between aid recipients and disbursing agencies and the explicit mechanism through which external expertise on these issues becomes incorporated into the judicial process. In this paper we explore the presence of (and changes in) ethnic-based glass ceiling effects over a ten-year period (1987 through 1997) in 106 multiethnic U. S. cities. This study employs a national data set obtained from the U. S. Equal Employment Opportunity Commission (EEOC) to answer the following questions: (1) to what extent are African Americans and Latinos represented in the top-level administrative positions in municipal government bureaucracies, and (2) are impediments that ethnic minorities might encounter in reaching the highest-level administrative posts related to the policy missions of these agencies? We find that, on average, Latinos and African Americans are severely underrepresented at the very highest administrative levels, indicating a pervasive presence of glass ceiling impediments for these groups. The greatest levels of underrepresentation occur in agencies with distributive and regulatory policy missions. The CF lung expresses a profoundly proinflammatory phenotype, due to constitutive hypersecretion of IL-8 from epithelial cells lining the airways. In a systematic search for candidate drugs that might be used therapeutically to suppress IL-8 secretion from these cells, we have identified a potent and efficacious series of amphiphilic pyridinium salts. The most potent of these salts is MRS2481, an (R)-1-phenylpropionic acid ester, with an IC50 of ca. 1μM. We have synthesized 21 analogues of MRS2481, which have proven sufficient to develop a preliminary structure–activity relationship (SAR). For optimal activity, we have found that the ester must be connected to the pyridinium derivative by an eight-carbon chain. An optical isomer of the lead compound, containing an (S)-1-phenylpropionic acid ester, has been found to be a much less active. The mechanism of action of MRS2481 appears to involve inhibition of signaling of the NFκB and AP-1 transcription factors to the IL-8 promoter. MRS2481 is a potent inhibitor of TNFα-induced phosphorylation and proteosomal destruction of IκBα. Inasmuch as IκBα is the principal inhibitor of the NFκB signaling pathway, preservation of intact IκBα would serve to keep the IL-8 promoter silent. We also find that MRS2481 blocks TNFα-activated phosphorylation of JNK, the c-JUN kinase. The IL-8 promoter is also activated by an AP-1 site, which requires a phospho-c-JUN/c-FOS dimer for activity. We therefore interpret these data to suggest that the mechanism of MRS2481 action is to inhibit both NFκB and AP-1 signaling on the IL-8 promoter. Given the medicinally promising properties of water-solubility, potency in the low μM concentration range, and high efficacy, we anticipate that MRS2481, or a further optimized derivative, may find an important place in the armamentarium of pharmaceutical strategies yet to be arrayed against the inflammatory phenotype of the CF lung. A regulatory negotiation is a multiparty negotiation in which a sponsoring regulatory agency convenes a group of representatives from diverse interest groups concerned about a proposed regulation of a particular subject matter. The explicit goal of the negotiation is to reach a consensus on a proposed regulation that will be published in a Notice of Proposed Rulemaking (NPRM). Regulatory negotiations usually operate on the basis of a consensus. For the purpose of a regulatory negotiation, consensus is usually defined as a solution that is acceptable to all members of the regulatory negotiation committee. One objector is enough to prevent a consensus from being reached. When that occurs, the agency can issue a NPRM that reflects its view of the rule and the participants can file adverse comments to the NPRM or file a lawsuit to prevent implementation of the rule. The advantage of the regulatory negotiation is that participants know the exact rule that will be published. It is often advantageous for industry representatives to compromise to obtain this certainty. Likewise, the regulating agency may compromise to reduce the potential for attack on the proposed regulation. The author examines major policies or goals that underlie subjective and objective aspects of the test to determine whether harassing conduct is sufficiently abusive and hostile to violate the law: (a) elimination of gender-biased norms, (b) eradication of harassment, and (c) uniformity. Four formulations of objective reasonableness are distinguished: the reasonable person, victim, woman, and employee. Problems demonstrated by courts in applying objective reasonableness standards are specified, many of which are attributed to inadequate definitional content. Empirical support for flexibility in the standard leads to recommendations favoring a reasonable victim standard that takes into account variations in the identity and circumstances of the victim including pertinent gender differences. We examined the effects of expert economic testimony, suggested awards, and conflicting economic testimony on decisions regarding lost wages and benefits and pain and suffering. Participants heard excerpts of an age discrimination lawsuit in which liability had previously been determined in the plaintiff's favor. We varied whether suggested awards were included and if so, whether they were presented by attorneys, a plaintiff's expert economist, or both a plaintiff's and defendant's expert economist. Results tentatively showed that attorney's suggestions were not persuasive and that the effects of expert testimony depend on its nature and on the particular decision task at hand. AB - Pre-employment examinations may be the most common medical examinations conducted in relation to work. Physicians who conduct these evaluations can create potential liability for employers and themselves by providing medical advice that does not consider the relevant aspects of the Americans with Disabilities Act (ADA). This statute addresses the timing and content of these examinations and decision-making relating to them. It prohibits disability-based discrimination in all aspects of employment. The law mandates that medical examinations be conducted only after an offer of employment is made to an applicant and that employers not reject candidates due to concerns about insignificant or uncertain future risks or groundless concerns about ability to perform essential job functions. Employers are required to maintain the confidentiality of medical information and to provide reasonable accommodations for qualified applicants with disabilities. Many of the cases brought under the ADA in relation to pre-employment medical evaluations are based on the theory that the employer wrongly regarded an applicant as disabled and incapable of performing the job or erroneously considered the candidate to be high risk for future injury. These issues are explored in summaries of two recent ADA cases. Physicians conducting these examinations are advised to take several steps to avoid involvement in a violation of the ADA. AB - Examined the possibility that death penalty attitudes influence jurors' conceptions of criminal intent, interpretations of trial evidence, and sentencing decisions. A jury simulation of a murder case was conducted. 198 mock jurors completed a pretrial questionnaire related to their beliefs about capital punishment, heard oral summaries of the evidence by prosecutor and defense counsel and then saw the footage of the murder of a convenience store clerk taken by a surveillance camera. The posttrial questionnaire asked for individual verdicts, a sentencing decision (i.e., life imprisonment or the death penalty) from jurors who voted for 1st degree murder, and responses to 5 questions that tapped jurors' recall of the factual evidence. The questionnaire also included statements that probed the interpretation and weight accorded to items presented in evidence and to thoughts about the verdict and sentencing. Jurors who favored the death penalty tended to read criminal intent into the defendant's actions and jurors who opposed the death penalty were less likely to do so. These data provide further explanation of the conviction-proneness of death-qualified (willing to consider imposing a death sentence) jurors. Merrell Dow Pharmaceuticals, Inc. in establishing guidelines for screening the admissibility of scientific evidence, including forensic psychological information is discussed. The author believes guidelines more akin to those advocated by psychologists to assess the trustworthiness of the expert testimony were established in light of the Federal Rules of Evidence. This includes guidelines for the reliability, relevance, and prejudicial or probative nature of the information. Forensic psychological experts will have to be explicit about the scientific foundations of their opinions. The more flexible formula for the admission of scientific evidence may exert greater quality control than the Frye test, and enhance the relationship of psychology and law by eliminating some sources of controversy within the professional community over expert witnesses. This article identifies factors mental health professionals should consider to meet that standard and Federal Rule of Evidence 702 when evaluating claims of psychological injuries as authorized by the Civil Rights Act of 1991, in cases of sexual harassment, retaliation, and other forms of employment discrimination. First, the contribution experts can make by presenting a framework to assess and understand the nature, duration, intensity and severity of emotional injuries is outlined, Specialized knowledge helpful in assessing these claims is reviewed in light of the scientific literature on stressors, anxiety disorders, somatoform disorders, depression, posttraumatic stress disorder, and ways in which t elated symptoms manifest regarding events in the workplace or following loss of employment. Second, the role of qualified experts to facilitate determinations of causation is discussed, highlighting factors that hear on preexisting harm, intervening injurious events, the exclusion of alternate sources of mental distress, emotional harm and humiliation, and mitigation of damages. The widely publicized study examined the treatment of tester pairs of apparently equally qualified young black and white men who applied for 576 jobs randomly selected from the employment sections of the local newspapers. In announcing the results of the Urban Institute study, its authors highlighted two sets of figures. First, 20 percent of the time, the white tester advanced farther in the selection process than the black tester, while the black tester advanced farther than the white tester only 7 percent of the time. Second, whites were favored in job offers 15 percent of the time, compared with 5 percent of the time for African American men. From comparisons like these, the authors found that hiring discrimination against the group was widespread. They also made a number of subsidiary findings such as African Americans experience unfavorable treatment at substantially higher rates in Chicago, Illinois than in Washington D.C. Thus, the authors concluded that the prevalence of disparate treatment in the hiring process means that greater efforts are needed to detect race discrimination. Title I of the ADA prohibits employment discrimination against a qualified individual with a disability on account of his or her disability. This prohibition reaches to all aspects of the employment relationship, including application procedures, hiring, promotion, compensation, training, and discipline. The ADA requires employers to make reasonable accommodations for qualified individuals with disabilities. The health professional should provide advice as the employer determines whether the individual has a covered disability. This means that the professional assists the employer in determining whether the individual has a physical or mental impairment and whether the impairment substantially limits a major life activity. The employer could be liable for violating the prohibitions of the ADA against screening out a qualified individual with a disability because of the disability. The physician also could be liable for the same discrimination if he was acting as an agent of the employer. The waiver provision of the OWBPA appears at Title II, Section 201. Here the Act contains threshold requirements for courts to determine whether waivers of rights under the Age Discrimination in Employment Act (ADEA) have been made knowingly and voluntarily. The requirements included in the Act state: the waiver is part of an agreement between the employee and the employer, and it has to be written in ordinary English; the agreement makes specific reference to rights and claims under the ADEA; the waiver does not waive rights or claims that may arise after the date of the agreement; the waiver is exchanged for valuable consideration in addition to what the individual would already be entitled to receive; the individual is advised in writing to consult with an attorney; and the individual is given a reasonable time period in which to review the agreement. It is important to note that the waiver provision speaks to the effect of legislation on the rights and responsibilities of the Equal Employment Opportunity Commission (EEOC) to enforce the law. It will continue to change as the impact of changes in immigration laws are felt and as ethnic violence commits havoc with economic and social stability throughout the world. Findings support the economic model of compliance in its conclusion that probability of detection and probable level of sanctions influence compliance decisions. Results also indicate that adjustments to the model that account for bounded rationality are valid. The key outcome, however, is that although all types of investigations play some role in enhancing compliance, those that stress sanctions and thus severity rather than certainty of detection may have the greatest positive influence on compliance. Enforcement programs attempting to operate simply as investigators of small-scale complaints will have less success than those with different types of investigations or a balanced type of single investigation. The results also suggest a more complex cognitive process on the part of regulated individuals than initially theorized. (ARAMCO). On March 26, 1991, the U.S. Supreme Court ruled in the transnational bias case that the U.S. Congress did not express an affirmative legislative intention to give the EEOC jurisdiction over race, color, religion, sex, or national origin discrimination charges overseas when it passed Title VII of the Civil Rights Act of 1964. Aramco defended itself against the claim by arguing that Title VII of the Civil Rights Act did not apply outside U.S. borders. The federal district court in Houston dismissed Boureslan's case, and the Court of Appeals for the Fifth Circuit upheld the dismissal. This became the first ruling by any court of appeals in the country to deprive EEOC of the ability to assert jurisdiction over discrimination charges by U.S. citizens employed by U.S. employers abroad. The subsequent effect of the Aramco ruling is that the EEOC will not have the authority to consider charges brought against private U.S. employers, as these charges relate to overseas job discrimination on the basis of race, sex, color, religion or national origin. Firefighters' Local No. 93 versus City of Cleveland, Ohio is a 1986 decision involving an affirmative action plan and other race-conscious relief provisions. In this case, an organization of African American and Hispanic firefighters employed by the city of Cleveland filed a class action suit in federal district court charging the city and various city officials with discrimination on the basis of race and national origin in hiring, assigning, and promoting firefighters in violation of Title VII of the Civil Rights Act of 1964. Much of the rationale used by petitioners in Firefighters was drawn from two prior affirmative action decisions of the Supreme Court, namely the Stotts and Wygant decisions, which were ruled illegal. Like the City of Cleveland decision, both Stotts and Wygant involved an affirmative action plan that allegedly impinged on the rights of nonminorities. The distinguishable difference in the latter two cases, however, related to seniority privileges impermissibly given to minority employees to the detriment of nonminorities. These cases reflect the High Court's opinions in the area of affirmative action. To be sure, the implications of the cases here are still being debated; in many circles, it is thought that these decisions have merely raised more questions that will be resolved only in future litigation. For more than a decade, management by objectives has been one of the key buzz-words in business and public administration. There is a good reason for this. One cannot know how to achieve goals if one does not know what one's goals are. Every professional/manager should therefore operate from a written set of objectives. Moreover, the objectives should be results oriented and not traits oriented. It is no help to be told that one must have a pleasant personality. It is much more helpful to be told that one must investigate facts before reaching conclusions and that one must state one's conclusions without fear but with tact. The most that any employer, private or public can be feasibly be asked to do in the area of professional/managerial evaluation is to make a good faith effort of evaluation after written standards have been promulgated. The least that the courts can be feasibly required to do is to consider the fairness of an evaluation a questions of fact to be decided with reference to the totality of circumstances in the case. Employers cannot be asked to quantify the more elusive aspects of professional/managerial evaluation nor may the courts abdicate their responsibility as triers of fact. Today, well over half of black children in this country are born to single women. Why are female-headed households multiplying now, when there is less discrimination and poverty than a couple of generations ago, when black family life was stronger? The disruption of the black family today is, in exaggerated microcosm, a reflection of what has happened to American family life in general. Public anxiety has mounted with the near-doubling of the proportion of white children living with one parent (from 9 percent to 17 percent) since 1970. The abuse of rights by some Title VII plaintiffs can only result in the erosion of those rights for many deserving individuals. In "Reed v. Sisters of Charity," plaintiffs brought a Title VII lawsuit against an order of nuns who had furnished medical and nursing service to the people of Louisiana for seventy years. The court found that the sisters operated the first medical facility in northern Louisiana to integrate voluntarily its facilities prior to any law so requiring it and had been in the forefront of acceptance of black patients and of granting staff privileges to black physicians. Further, none of their decisions relating to any of the plaintiffs was racially discriminatory. The court concluded that the claims were insubstantial and frivolous. Not a single count was proven, "even remotely," against the defendant, and the lawsuit was vexatious in the highest degree. An employer whose personnel policies and practices are devoid of discrimination should not, as a matter of policy, be subject to lawsuits that by definition cannot be proved. Economic theory and economic history bear out that the free enterprise system is conducive to the greatest good for the greatest number because it promotes the optimum allocation of scarce resources. In order to preserve a competitive economic environment, Congress has enacted antitrust laws. These laws, however, have not affected lack of competition in labor markets. EEO laws are designed to eliminate discrimination. Ending discrimination will make labor markets competitive and conducive to proper allocation of labor resources. The Guidelines were not issued by the Federal Fair Test Commission or the Federal Validation Commission. These Guidelines carry forward a definition of discrimination which was originally adopted by the Equal Employment Opportunity Commission in a set of Guidelines in 1966 and consistently adhered to by the government and ratified by both the Supreme Court and the Congress. In 1971, the Supreme Court approved a definition of discrimination which focused on unjustified adverse impact, and in 1972 the Congress also approved that definition. The standard for justifying an employment practice or system with an adverse impact under federal antidiscrimination law is that it must meet a business necessity standard. The selection guidelines indicate what is expected of an employer--eliminating unjustified systems with adverse impact. The affirmative action guidelines encourage him to do this voluntarily and provide protection for such voluntary action. The purpose of this article is to clarify what for an increasing number of psychologists has become the very trying experience of a Title VII court proceeding. In attempting to summarize the impact that lawyers, legal language and legal thinking have had on the contemporary practice of industrial psychology, three lines of reasoning will be developed. First of all, any attempt to understand the thinking of the lawyer in the role of an advocate would be blind without an insight into the professional ethics which govern the lawyer's conduct. The ethical canons of the attorney as an advocate will be contrasted with those of the psychologist as an applied behavioral scientist. Second, it is important that we begin as a profession to understand just how the judicial process influences the role we are increasingly being asked to assume in Title VII proceedings. Finally, an attempt to identify a number of implications of this interaction between the advocate and the behavioral scientist will be made for the practicing industrial/organizational psychologist. It reports that in 1972, the Equal Employment Opportunity Act gave Equal Employment Opportunity Commission (EEOC) court enforcement powers. Coverage of Title VII was also extended to employees of educational institutions, and to state and local government employee.
