The 1978 Outer Continental Shelf Lands Act Amendments imposes upon such vessel owners and operators a new liability for damages and removal costs resulting from oil discharges. Vessel-operators must demonstrate their financial capability of meeting such potential liability up to certain limits, before their vessels may lawfully engage in any segment of oil transportation from an offshore facility above the Outer Continental Shelf. These regulations set forth the manner by which Financial responsibility can be demonstrated to the Commission. They provide for the issuance of Certificates of Financial Responsibility which must be carried aboard vessels and presented upon request to officials or designees of the U.S. Coast Guard. That subsection makes the owners and operators of vessels carrying oil which has been transported through the trans-Alaska pipeline, jointly, severally, and strictly liable for damages resulting from the discharge of oil from such vessels. The subsection further requires proof of financial responsibility for $14 million before such oil may be loaded aboard a vessel. The applicant may establish its financial responsibility by filing an insurance form, a surety bond form, or by maintaining in the United States working capital and net worth of $19 million or more, depending upon the number of vessels. The regulations will be enforced by the Coast Guard. A vessel engaged in a prohibited activity may be denied entry into any port of the United States, and may be detained at any port. The regulations also set standards for certificates; procedures for application and issuance; and the grounds for denial and revocation.
